RTI Relaxation of rules for SME’s

Until October 2013, those with 50 or fewer employees get more time to report to HMRC

HMRC has today announced a relaxation of Real Time Information (RTI) reporting arrangements for small businesses in the first six months of the new system.

HMRC says: “Until 5 October 2013, employers with fewer than 50 employees, who find it difficult to report every payment to employees at the time of payment, may send information to HMRC on the date of their regular payroll run but no later than the end of the tax month (5th).”

COMPANIES AND EMPLOYERS
Mr Osborne extended his cuts to corporation tax, reducing the main rate to 20% by April 2015, down from 28% when the coalition government came to power.
He also introduced a new “employment allowance” for every company in the country, reducing their total employer National Insurance by £2,000 each. It is estimated that 450,000 small firms will pay no employer National Insurance.
Employers will be able to offer their staff up to £10,000 per person in tax-free annual season ticket loans.
In addition, it was announced that Government procurement from small firms is to rise fivefold and there would be tax relief for investment in social enterprises.

INCOME TAX
To help middle-earners, Mr Osborne promised to increase the personal allowance to £10,000 in April 2014, a year earlier than first planned. “If you want to work hard and get on, we are on your side,” Mr Osborne said. “This is a budget for an aspiration nation.”

PENSIONERS
The flat-rate pension worth £144 a week will be brought forward to 2016. The cap on social care costs will come in 2017 and will protect savings above £72,000. The threshold for means-tested help will be raised from £23,000 to £118,000.

FAMILIES
The Budget confirmed the government’s announcement on Tuesday of a new system of taxpayer subsidy for childcare.
Tax-free childcare vouchers, worth £1,200 per child, will be on offer, along with increased support for families with children on universal credit.
Fom the autumn of 2015, working parents will be able to claim vouchers to subsidise the cost of childcare for every child under five.
Parents earning up to £150,000 will be able to claim back up to £1,200 of childcare costs a year.

EBT – Rangers case won

Employee Benefit Trusts tax case – Rangers 1 HMRC 0

A first-tier tribunal has ruled that payments made to players and staff at Rangers Football Club in a tax scheme were not illegal.

The scheme was in place between 2001 and 2010 to pay substantial sums to players and staff. It argued that the payments were loans rather than actual earnings and not subject to tax.

Following a challenge from HMRC the club appealed its use of Employee Benefit Trusts (EBTs), arguing that the payments were loans which can be repaid.

The ruling [TC02372] said: “The majority view reflects the argument that the controversial monies received by the employees were not paid to them as their absolute entitlement. The legal effect of the trust/loan structure is sufficient to preclude this. Thus the payments are loans, not earnings, and so are recoverable from the employee or his estate.”

HMRC is now considering an appeal.

We are different

Accounts and tax is easy, if you have the knowledge. Most people can gain the knowledge but knowing how and when to use it is all about being different. One important lesson I learned from the master was to be ‘forever vigilant’, that is to identify opportunities and apply your knowledge for the benefit of your client. This is just one of our differentiating skills.

For instance, we were recently engaged to solely prepare capital gains tax computations and a tax return for a client.
